These Terms and Conditions (the “Agreement”) govern the provision of services by Mavelo (“Company,” “we,” “us,” or “our”) to you (“Client” or “you”). By requesting, purchasing, accepting, or using Mavelo’s services, or by clicking “accept” or “agree” where applicable, you acknowledge that you have read, understood, and agree to be legally bound by this Agreement. You represent that you are legally capable of entering into this Agreement on behalf of yourself or your organization.

 

If you do not agree to these Terms, you must not solicit, accept, or use Mavelo’s services.

 

These Terms incorporate Mavelo’s Privacy Policy by reference. Continued use of the services constitutes acceptance of both documents.

  1. Concept Validation

A concept is considered validated when the client provides explicit approval of the initial website concept, either by:

 

- Email confirmation, or

- Submitting feedback with a rating of 6 points or above (on a 1–10 scale), or written approval of the design direction.

 

Concept validation confirms that the overall structure, style, and layout direction are accepted. Revisions may still be requested within the project workflow, but the project is considered to have progressed beyond initial exploration.

  1. Services

Mavelo provides design, web & mobile app development (via no-code/low-code tools), branding and related services as listed on the Site. Specific terms, deliverables, timelines and pricing will be agreed in a separate service/customer contract or order form.

  1. Client obligations

If more than 7 days have passed since concept validation:

  • Requests between 7 and 14 days may qualify for a 40–60% refund, depending on progress:
    • 1–2 revision rounds → up to 60%
    • 3–4 revision rounds → up to 40%
  • Requests after 14 days but before final delivery are reviewed case-by-case.

Full Website Ecosystem packages are not eligible for partial refunds. Where appropriate, Mavelo may offer alternate layouts, additional concepts, or service credits instead of monetary refunds.

  1. Non-Refundable Situations

Refunds are not available if:

    • 14 or more days have passed since concept validation
    • Final files or ecosystem assets have been delivered or accessed
    • Five or more revision rounds are completed
    • The project is delayed due to no client response for 7+ days after three documented follow-ups

Exceptions

Mavelo will take responsibility in cases of verified plagiarism or major technical defects that make deliverables unusable.

  1. Client Inactivity and Project Completion

If the client does not respond or provide required feedback within 20 calendar days, the project may be marked complete after three contact attempts.

    • Work completed to date will be delivered as is.
    • No additional revisions or refunds will be issued.
  1. Post-Delivery Changes

Any changes requested after final delivery—including new pages, layouts, or scope changes—require a separate agreement and additional fees.

  1. Resolution Before Refunds

Before processing a refund, Mavelo may offer reasonable solutions, including:

  • Assignment to a different designer
  • Alternate design directions
  • Direct support from a project or creative lead

These steps are optional and intended to resolve concerns efficiently.

  1. Payments and Invoicing

All fees are outlined in the agreed proposal or invoice and are payable within the timeframe stated on the invoice. Late payments may result in suspension of services. Mavelo reserves the right to charge reasonable late fees or interest where permitted by law.

  1. Termination

Either party may terminate the project with written notice. Upon termination, the client remains responsible for payment of all work completed up to the termination date. Refund eligibility remains governed exclusively by this Agreement.

  1. Communication Channels (WhatsApp, Email, Booking Tools)

Mavelo may provide contact options via WhatsApp, email, or scheduling tools. By initiating contact, you agree that:

  • Your contact details are provided voluntarily for business communication.
  • Mavelo may reply using the same channel.
  • Project-related reminders or follow-ups may be sent.

You will not be added to unrelated marketing communications without explicit consent. Mavelo does not sell or rent your contact details to third parties for their own marketing purposes.

  1. Acceptable Use and Client Responsibilities

You agree that:

  • No illegal, defamatory, abusive, or infringing content will be provided.
  • All materials you supply are owned or properly licensed.
  • Final designs are reviewed and approved before use or launch.

Mavelo reserves the right to decline projects that violate applicable laws or platform policies.

  1. Confidentiality

Both parties agree to keep confidential any non-public business, technical, or strategic information shared during the project. Confidential information may only be used for purposes related to the project and may not be disclosed without prior written consent, except as required by law.

  1. Intellectual Property
  • Ownership of final approved deliverables transfers to the client only after full payment of all outstanding fees.
  • Mavelo retains ownership of internal tools, working files, templates, processes, methodologies, and unused concepts (“Background IP”).
  • Mavelo may display non-confidential work in portfolios or case studies unless the client opts out in writing before project completion.

  1. Full Refund Guarantee (Web Design Only)

You may request a full 100% refund for web design services only under the following conditions:

Before concept validation

  • A full refund may be requested at any time prior to approval of the initial concept.

After concept validation

  • A full refund may be requested within 7 calendar days after validation, provided that no final files, exports, live implementations, handoffs, or usable assets have been delivered or accessed.

This refund framework is intended to ensure transparency and reduce risk when engaging Mavelo.

Important Notes

  • Once final deliverables have been provided, the project is considered complete and non-refundable, regardless of whether the files are downloaded, accessed, or implemented.
  • Full Website Ecosystem packages are fully customized services and are non-refundable once production begins, which occurs when the onboarding form is submitted and work starts.
  1. Partial Refunds (Web Design Only)

If more than 7 days have passed since concept validation:

  • Requests between 7 and 14 days may qualify for a 40–60% refund, depending on progress:
    • 1–2 revision rounds → up to 60%
    • 3–4 revision rounds → up to 40%

  1. Limitation of Liability

To the maximum extent permitted by law:

  • Mavelo makes no guarantees regarding traffic, revenue, conversions, or business outcomes.
  • Mavelo shall not be liable for indirect, incidental, or consequential damages.
  • Mavelo’s total liability shall not exceed the amount paid by the client for the services giving rise to the claim.
  1. Force Majeure

Mavelo is not liable for delays or failure to perform caused by events beyond reasonable control, including but not limited to acts of God, internet outages, third-party service failures, or governmental actions.

  1. Governing Law

This Agreement is governed by the laws of [Insert Country / Jurisdiction], without regard to conflict-of-law principles.

  1. Changes to These Terms

Mavelo may update these Terms from time to time. Continued use of services after updates constitutes acceptance of the revised Terms.
